Terms of Use

1. Acceptance of Terms
By accessing or using Hotzapp services, you agree to these Terms of Use. If you do not agree with any provision, do not use our services.
2. Definitions
- Platform: the WhatsApp CRM software provided by Hotzapp
- User: individual or entity that uses the Platform
- Account: individual registration on the Platform
- Content: any information, message, or data entered into the Platform
3. Registration and Account
To use the Platform, you must create an account providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials and for all activities performed on your account.
4. Permitted Use
The Platform must be used exclusively for legitimate commercial communication via WhatsApp. It is prohibited to:
- Send spam or unsolicited mass messages
- Violate WhatsApp Business usage policies
- Use the Platform for illegal activities
- Share offensive, defamatory, or discriminatory content
- Attempt to access systems or data without authorization
5. Plans and Payment
Services are offered in different subscription plans. Pricing and features for each plan are available on the pricing page. Payment is made on a recurring basis according to the contracted plan.
6. Trial Period
New users may enjoy a 7-day free trial period. At the end of the period, a paid plan must be contracted to continue using the Platform.
7. Cancellation
Subscription cancellation can be done at any time through account settings. Access to the Platform will remain active until the end of the already paid period. There is no proportional refund for partial periods.
8. Intellectual Property
All intellectual property rights over the Platform, including software, design, brands, and content, belong exclusively to Hotzapp. The User does not acquire any rights over the Company's intellectual property.
9. User Responsibilities
The User is responsible for all content sent through the Platform, including messages, media, and contact data. The User must ensure they have authorization to send messages to recipients and that the content complies with applicable legislation.
10. Limitation of Liability
Hotzapp is not liable for indirect, incidental, or consequential damages arising from the use of the Platform. Our total liability is limited to the amount paid by the User in the last 12 months.
11. Service Availability
We strive to keep the Platform available 24/7, but we do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance. We are not responsible for unavailability caused by third parties, including WhatsApp.
12. Privacy and Data Protection
Personal data processing is governed by our Privacy Policy, which is an integral part of these Terms of Use.
13. Changes to Terms
We reserve the right to change these Terms at any time. Significant changes will be communicated by email or through the Platform with at least 30 days' notice. Continued use after changes implies acceptance of the new terms.
14. Jurisdiction and Applicable Law
These Terms are governed by the laws of the Federative Republic of Brazil. The jurisdiction of the district of São José/SC is elected to resolve any disputes, with express waiver of any other, no matter how privileged.
